Rent agreement expired? Renewal rules and reminders for landlords in India
The short answer
- An expired agreement does not end the tenancy. If you keep accepting rent, the tenant usually continues month to month on the old terms.
- What you lose is leverage: no agreed rent increase, no fresh term, and weaker paperwork if things go wrong.
- Renew in writing before the end date, on correctly stamped paper, for 11 months unless you register a longer lease.
- Track the end dates. Start the conversation 60 days out and you will rarely be caught short.
Most Indian residential agreements run for 11 months, so a landlord with a handful of tenants has a renewal coming up almost every month. And because nothing visibly changes when one lapses, with the same tenant and the same rent landing on the same date, it is very easy not to notice.
Usually nothing goes wrong. The problem shows up later: when you want to raise the rent, when the tenant needs a current agreement for a bank or HRA claim, or when a dispute starts and the only document you hold expired a year and a half ago.
Why agreements are 11 months in the first place
Under the Registration Act 1908, a lease for a term exceeding one year, or from year to year, must be registered with the sub-registrar. An unregistered lease that needed registration cannot be relied on as evidence of the lease itself. Keeping the term to 11 months stays under that line, so the agreement is valid if it is properly stamped and signed.
Two cautions. First, stamp duty is still payable, since it is a separate obligation from registration. Second, some states have their own rules. Maharashtra, for example, requires leave and licence agreements to be registered whatever their length. Our rent agreement generator walks through the stamping and registration steps.
What actually happens when the agreement lapses
It depends on what you do next and on where the property is.
| Situation | What generally follows |
|---|---|
| You keep accepting rent, no new agreement | The tenant is holding over. Under Section 116 of the Transfer of Property Act the tenancy is usually treated as renewed month to month on the old terms, subject to your state’s rent law. |
| Your state has adopted the Model Tenancy Act | An unrenewed tenancy is deemed renewed month to month, on the same terms, for up to six months. |
| The tenancy has ended and the tenant will not leave | In Model Tenancy Act states, the tenant owes twice the monthly rent for two months and four times after that. Possession still comes through the Rent Court. |
| You sign a renewal before the end date | A fresh term, on the terms you just agreed. This is the goal. |
Notice what holding over does not give you: a new rent. If your old agreement said ₹20,000 and you and the tenant agreed on ₹21,500 over the phone, the only rent in writing is still ₹20,000.
How to renew a rent agreement properly
- Around 60 days before the end date, talk to the tenant: are they staying, and on what rent? If you plan to raise it, this gives them time to decide, and is well inside the three months’ notice the Model Tenancy Act expects when an agreement is silent on revision.
- Around 30 days out, agree the terms in writing. A WhatsApp message confirming the new rent, deposit top-up and start date is enough at this stage.
- Before the end date, sign either a new 11-month agreement or a short renewal deed that extends the old one with the changed terms. Either needs fresh stamp duty.
- Top up the deposit if it is linked to the rent and the rent has gone up, and record it.
- Scan the signed copy, every page, including the stamp paper or e-stamp certificate, and file it against the tenant with the new end date.
New agreement or renewal deed?
| New 11-month agreement | Renewal deed | |
|---|---|---|
| Paperwork | Full agreement again | One or two pages referring to the original |
| Best when | Terms changed a lot, or the old agreement was weak | Only the rent and dates change |
| Watch out for | Carrying over clauses you meant to fix | Losing track of which clauses are now in force |
If the old agreement was a hurried template with no deduction, notice or maintenance clauses, renewal is the cheapest moment to replace it.
Tracking renewal dates without a spreadsheet you forget to open
With one flat, a phone reminder does the job. With five or fifty units, agreements lapse in a rolling pattern and the reminder system is what actually matters. Whatever you use, it needs three things:
- the end date stored against each tenant, not buried in a PDF;
- a warning that comes to you about a month before, not a sheet you have to remember to check;
- the signed copy one tap away, so the renewal conversation starts from the actual clauses.
Frequently asked questions
What happens if a rent agreement expires and the tenant continues to stay?
If you keep accepting rent without a new agreement, the tenancy generally continues by holding over. Under Section 116 of the Transfer of Property Act, a residential tenancy is then usually treated as renewed month to month on the old terms, unless your state's rent law provides otherwise. In states that have adopted the Model Tenancy Act, an unrenewed tenancy is deemed renewed month to month on the same terms for up to six months. Either way, the old rent and terms keep applying until you sign something new.
Is it compulsory to renew a rent agreement every 11 months?
No law says an agreement must run for 11 months. The 11-month term is a convention: a lease for more than a year must be registered under the Registration Act 1908, and 11 months stays under that line. A few states go further — Maharashtra, for example, requires leave and licence agreements to be registered whatever their length. Once the term ends, renewing in writing is what keeps your terms enforceable.
Do I need to pay stamp duty again when renewing a rent agreement?
Yes. A renewal is a fresh instrument, whether it is a new agreement or a supplementary renewal deed, and stamp duty is payable on it at your state's rate. Buy stamp paper of the right value or generate an e-stamp certificate for the new term.
How much can a landlord increase rent on renewal?
In most of India, whatever the landlord and tenant agree, since rent levels are not capped for new agreements outside older rent-control tenancies. The Model Tenancy Act likewise leaves the rent to the parties, but where the agreement is silent on revision it expects three months' written notice before a revised rent takes effect. Whatever the figure, write it into the renewed agreement rather than agreeing it verbally.
Can a landlord ask a tenant to vacate when the agreement expires?
The end of the term is the natural point to do it, but give written notice as your agreement requires, ideally well before the end date. If the tenant stays on without your consent and you refuse rent, you may have to seek possession through the court or, in Model Tenancy Act states, the Rent Court. Those states also make an overstaying tenant liable for twice the monthly rent for two months and four times after that.
Should I keep a scanned copy of the signed rent agreement?
Yes. Keep the original somewhere safe and a full scan of every page, including the stamp paper or e-stamp certificate and all signatures and witness details. The scan is what you will actually reach for when sending a legal notice, answering a tenant's HRA or address-proof request, or checking a clause at renewal time.
Every signed agreement, with its end date on watch
In the Nestwise web portal you upload each tenant’s signed agreement, whether a PDF or a photo of the pages, with its start and end dates. Your tenant list then flags agreements ending within 30 days and those that have lapsed, and the warning clears when you upload the renewal. Earlier agreements stay on file as history. Agreements are visible only to you and your managers. Free while in early access.
