Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Nestwise Telegram bot and website at nestwise.online (the “Service”), operated by DPIIND Services Pvt Ltd (“Nestwise”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What Nestwise is (and is not)

Nestwise is a software tool that helps landlords and tenants manage rentals — reminders, collecting payment proofs, receipts, and reports. Nestwise is not a party to any tenancy or agreement between a landlord and a tenant, is not a real-estate agent, and is not a payment processor, bank, or financial institution. Rent and deposits are paid directly between tenant and owner through their own UPI or bank arrangements; Nestwise never holds, processes, or transfers money. Receipts and statements generated by the Service are records of information you enter and are not legal, tax, or accounting advice.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it to these Terms.

3. Accounts and security

You are responsible for the activity on your account and for keeping your Telegram account and any credentials secure. Notify us promptly of any unauthorised use.

4. Your responsibilities

• You are solely responsible for the accuracy, legality, and lawfulness of the information you enter (properties, tenants, amounts, IDs, bank details, receipts).
• Owners are responsible for obtaining any necessary consent from their tenants to store and process the tenants’ personal data via the Service, and for their own compliance with rental, tax, and other laws.
• You will not use the Service for any unlawful, fraudulent, or abusive purpose, or to infringe anyone’s rights.

5. Fees

The Service may offer free and paid plans. Where fees apply, they will be disclosed to you before you incur them. We may change plans and pricing on reasonable notice.

6. Third-party services

The Service depends on Telegram and on UPI/banking apps chosen by users. Your use of those services is governed by their own terms, and we are not responsible for their availability, actions, or failures.

7. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that reminders, messages, or receipts will always be delivered or accurate.

8. Limitation of liability

To the maximum extent permitted by law, Nestwise and its directors, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service — including, without limitation, any disputes over rent or deposits between tenants and owners, missed or late reminders, payment failures, or reliance on any receipt, statement, or figure produced by the Service.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total fees you paid to us for the Service in the three (3) months before the event giving rise to the claim, or (b) INR 1,000.

9. Indemnification

You agree to indemnify and hold harmless Nestwise from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content or data, or your breach of these Terms or of any law or third-party right.

10. Suspension and termination

We may suspend or terminate your access if you breach these Terms or use the Service unlawfully or in a way that risks harm to others or to the Service. You may stop using the Service at any time.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Bangalore, Karnataka will have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use of the Service after changes means you accept the revised Terms.
